Faith Baptist Church (“we,” “our,” or the “Ministry”) is committed to protecting the privacy of all individuals who interact with our ministries, website(s), and digital platforms. This Privacy Policy explains how we collect, use, store, and protect your information, and the rights you may have under applicable law.
1. Scope.
This policy applies to our website, online forms, email, text messaging, and other electronic communications, information collected through in-person ministry activities when added to our systems, and all ministries, programs, and outreaches operated by the Ministry.
As a non-profit religious organization, we are likely exempt from the California Online Privacy Protection Act (CalOPPA), which applies to every organization that operates websites collecting private information from California consumers and requires them to post a conspicuous privacy policy on its website stating the information being collected and those individuals and companies with whom it is being shared. However, in a good-faith effort to ensure transparency, we maintain a conspicuous Privacy Policy link labeled “Privacy” on our website’s homepage or first significant page, and we strive to allow anonymous browsing where feasible (subject to automatic collection of technical data, including cookies, as noted in Section 2).
2. Information We Collect.
We may collect the following categories of information:
- Personal Information: Name, address, email, phone number, date of birth, donation/payment information, volunteer applications, and membership records.
- Sensitive Information: Pastoral care requests, prayer requests, counseling notes, and health-related information shared voluntarily.
- Children’s Information: For children under 13, we only collect information from parents or legal guardians, in compliance with the Children’s Online Privacy Protection Act (COPPA).
- Technical Information: IP address, browser type, device identifiers, and usage data collected automatically when you use our website.
- Cookies and Similar Technologies: We use cookies and similar technologies to enhance website functionality, analyze usage, and support services like online donations.
- Essential Cookies: Necessary for website operation (e.g., session management).
- Analytics Cookies: To understand how users interact with our site (e.g., via Google Analytics), often anonymized.
- Third-Party Cookies: Set by service providers (e.g., donation platforms) for functionality or analytics, subject to their privacy policies. You can manage cookies via browser settings or opt-out tools where available. For children under 13, we do not use cookies to collect personal information without parental consent, per COPPA. While not legally required as a non-profit, we disclose cookie use in good faith to ensure transparency.
3. How We Use Information.
We use information for the following purposes:
- To operate church programs, ministries, and events.
- To process donations, tithes, and purchases.
- To communicate about Ministry news, events, and opportunities.
- To provide pastoral care and ministry support with your consent, where applicable (e.g., sharing testimonials)
- To comply with legal obligations (e.g., tax reporting of donations).
- To improve and secure our websites and platforms.
4. How We Share Information.
We do not sell personal information. We may share information only in the following limited ways:
- With Service Providers: Payment processors, background check providers, IT vendors, and email platforms who assist us in Ministry operations.
- With Consent: If you give permission (e.g., publishing a testimony or prayer request).
- As Required by Law: To comply with lawful requests, court orders, or legal obligations.
- For Safety and Security: Where necessary to protect individuals, property, or the church.
- With Affiliated Religious Entities: Where necessary for joint ministry purposes, subject to similar privacy protections.
5. Data Protection & Security.
We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure. In the event of a data breach, we will follow applicable notification laws and notify affected individuals promptly where required.
6. Your Rights (Utah & Federal Law).
As a non-profit religious organization, we are exempt from the Utah Consumer Privacy Act (UCPA). However, in a good-faith effort to respect your privacy, we voluntarily offer Utah residents the following rights, subject to legal and operational limitations:
- To know what categories of personal data we process.
- To access and request a copy of your personal information.
- To request correction or deletion of personal data (subject to legal record-keeping requirements).
- To opt out of targeted advertising or sale of personal data (we do not sell data).
To exercise these rights, contact us at one of the methods listed below. We will respond to requests within 30 days, subject to verification of your identity. Under federal law, additional rights may apply in specific contexts (e.g., Fair Credit Reporting Act for background checks).
7. Children’s Privacy.
We do not knowingly collect information online from children under 13 without parental consent, in compliance with COPPA. Parents may request review or deletion of their child’s information by contacting us.
8. Communications & Email.
- Emails are sent in compliance with the CAN-SPAM Act. As a non-profit, we are exempt from certain CAN-SPAM requirements for non-commercial messaging (e.g., ministry updates), but we voluntarily provide an opt-out option. You may opt out at any time by clicking “unsubscribe” or contacting us directly.
- Text messages comply with the Telephone Consumer Protection Act (TCPA). You will not receive texts unless you opt in, and you can opt out by replying “STOP.”
9. Health & Counseling Information.
To the extent health information is shared with pastoral staff or through Ministry-run programs, it will be treated with strict confidentiality. While we are not a HIPAA-covered entity, we apply privacy safeguards consistent with pastoral care best practices.
10. Data Retention.
We retain personal information only as long as necessary to fulfill ministry purposes, meet legal obligations (such as IRS donation recordkeeping for at least 7 years), or resolve disputes.
11. Third-Party Links.
Our website may link to third-party sites (e.g., online giving platforms). We are not responsible for the privacy practices of those sites.
12. Updates to This Policy.
We may update this Privacy Policy from time to time. The “Effective Date” at the end of this policy will show the last revision date. Continued use of our platforms after updates constitutes acceptance.
